Statement of Rights and Responsibilities

This Statement of Rights and Responsibilities (Statement) governs our relationship with users and others who interact with Event Plus. By using or accessing Event Plus, you agree to this Statement.

Privacy

Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how you can use Event Plus to share with others and how we collect and can use your content and information. We encourage you to read the Privacy Policy, and to use it to help make informed decisions.

Sharing Your Content and Information

You own all of the content and information you posted on Event Plus. In addition:


2.1.For content that is covered by intellectual property rights, like photos and videos (“IP content”), you specifically give us the following permission: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you posted on or in connection with Event Plus.

2.2.When you publish content or information, it means that everyone, including people off of Event Plus, will have access to that information and we may not have control over what they do with it.

2.3.We always appreciate your feedback or other suggestions about Event Plus, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

2.4.The video you uploaded on YouTube and shared on Event Plus via the YouTube “Embeddable Player” follows the terms of content ownership of YouYube. Event Plus bears no obligation and responsibility of the video you uploaded on YouTube.

Safety

We do our best to keep Event Plus safe, but we cannot guarantee it. We need your help to do that, which includes the following commitments:


3.1.You will not send or otherwise post unauthorized commercial communications (such as spam) on Event Plus.

3.2.You will not collect users’ content or information, or otherwise access Event Plus, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.

3.3.You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on Event Plus.

3.4.You will not upload viruses or other malicious code.

3.5.You will not solicit login information or access an account belonging to someone else.

3.6.You will not bully, intimidate, or harass any user.

3.7.You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.

3.8.You will not use any of the commonly known foul language.

3.9.You will not provide any fake information on Event Plus.

3.10.You will not advertise or otherwise market mature content without appropriate age-based restrictions. (Please see Advertising Guidelines)

3.11.You will not use Event Plus to do anything unlawful, misleading, malicious, or discriminatory.

3.12.You will not do anything that could disable, overburden, or impair the proper working of Event Plus, such as a denial of service attack.

3.13.You will not facilitate or encourage any violations of this Statement.

Registration and Account Security

Event Plus users provide their real names and information, and we need your help to keep it that way. Here are some commitments you make to us relating to registering and maintaining the security of your account:


4.1.You will not provide any false personal information on Event Plus, or create an account for anyone other than yourself without permission.

4.2.You will not use your personal profile for your own commercial gain (such as selling your profile to an advertiser).

4.3.You will not use Event Plus if you are under 13.

4.4.You will keep your contact information accurate and up-to-date.

4.5.You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.

4.6.You will not transfer your account to anyone without first getting our written permission.

4.7.If you select a username or a display name for your account we reserve the right to remove or reclaim it if we believe appropriate (such as when a trademark owner complains about a username that does not closely relate to a user’s actual name).

Protecting Other People’s Rights

We respect other people’s rights, and expect you to do the same.


5.1.You will not post content or take any action on Event Plus that infringes or violates someone else’s rights or otherwise violates the law.

5.2.We can remove any content or information you posted on Event Plus if we believe that it violates this Statement.

5.3.If you repeatedly infringe other people’s intellectual property rights, we will disable your account when appropriate.

5.4.You will not use our copyrights or trademarks (including Event Plus, the Event Plus Logos, etc.), or any confusingly similar marks, without our written permission.

5.5.If you collect information from users, you will: obtain their consent, make it clear you (and not Event Plus) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.

5.6.You will not post anyone’s identification documents or sensitive financial information on Event Plus.

Protecting Original Information and Materials on Event Plus

6.1.Copying of information (such as event descriptions) and materials (such as graphics and html codes) originated by Event Plus (by any means) is strictly prohibited.

6.2.Copying of other information and materials from Event Plus onto other websites and media is allowed, provided that copies of the information and materials (in any forms) contain quotes of original information source (for example, url of the event page) and other existing quotes attached on the information and materials.

Mobile

We currently provide our mobile services for free, but please be aware that your carrier’s normal rates and fees, such as text messaging fees, will still apply.

Payments

If you make a payment on Event Plus, you agree to our Payments Terms.

About Advertisements on Event Plus

Our goal is to deliver ads that are not only valuable to advertisers, but also valuable to you. In order to do that, you agree to the following:


9.1.We do not give your personal information (like name and contacts) to advertisers without your consent.

9.2.You understand that we may not always identify paid services as such.

Special Provisions Applicable to Advertisers

The following additional terms apply to you if you place an advertisement (“Order”) to Event Plus:


10.1.When you want to place an Order, you will provide us the event information by creating usual events. If we accept your Order, we will promote your events as ads as inventory becomes available.

10.2.You will pay for your Orders in accordance with our Payments Terms. The amount you owe will be calculated based on our pricing mechanisms.

10.3.Your ads will comply with our Advertising Guidelines.

10.4.We will determine the size, placement, positioning and timing of your ads.

10.5.We do not guarantee the activity that your ads will receive, such as the number of clicks you will get.

10.6.We cannot control how people interact with your ads, and are not responsible for click fraud on your ads and attached url or other improper actions that affect the cost of running ads.

10.7.Our license to run your ad will end when we have completed your Order. You understand, however, your ad is still searchable in Event Plus (but our user interface does not encourage it) and may be copied to somewhere else by users when your ad is posted within the order period.

10.8.We can use your ads and related content and information for marketing or promotional purposes.

10.9.You may issue press release or make public statements about your relationship with Event Plus, but the reversed is not permitted unless there is a written agreement.

10.10.We may reject or remove any ad for any reason.

10.11.The video you uploaded on YouTube and the link you put in the YouTube “Embeddable Player” on Event Plus follows all terms of YouYube. Event Plus bears no obligation and responsibility of your action of putting the video on YouTube. However, as far as the content of the video is concered, Event Plus’s terms override YouTube’s terms, referring to the “Advertising Guilelines” of Event Plus.


If you are placing ads on someone else’s behalf, we need to make sure you have permission to place those ads, including the following:


10.12.You warrant that you have the legal authority to bind the advertiser to this Statement.

10.13.You agree that if the advertiser you represent violates this Statement, we may hold you responsible for that violation.

Amendments

11.1.We can change this Statement if we provide you notice by posting the change on the Event Plus Terms Page.

11.2.We can make changes for legal or administrative reasons upon notice without opportunity to comment.

Termination

If you violate the letter or spirit of this Statement, or otherwise create possible legal exposure for us, we can stop providing all or part of Event Plus to you. We will notify you by email or at the next time you attempt to access your account. In all such cases, this Statement shall terminate, but the terms related to remaining and prolonged property will still be effective.

Disputes

13.1.You will resolve any claim, cause of action or dispute (“claim”) you have with us arising out of or relating to this Statement or Event Plus exclusively in Hong Kong. The laws of Hong Kong will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Hong Kong for the purpose of litigating all such claims.

13.2.If anyone brings a claim against us related to your actions, content or information on Event Plus, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

13.3.WE TRY TO KEEP EVENT PLUS UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING EVENT PLUS “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT EVENT PLUS WILL BE SAFE OR SECURE. EVENT PLUS IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR EVENT PLUS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Special Provisions Applicable to Users Outside Hong Kong

We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users outside Hong Kong:


14.1.You consent to having your personal data transferred to and processed in Hong Kong, or any other location that we placed our infrastructure without notice.

Definitions

15.1.By ” Event Plus ” we mean the features and services we make available, including through (a) our website at eventplus.com (and its derivatives like www. eventplus.com, www.eventplus.com.hk, www.eventplus.hk, m.eventplus.com etc.) and any other Event Plus branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (b) our applications (like iOS application, Android application, etc.) ; (c) our Platform; and (d) other media, software (such as a toolbar), devices, or networks now existing or later developed.

15.2.By “us,” “we” and “our” we mean Event Plus.

15.3.By “Platform” we mean a set of APIs and services that enable applications, developers, operators or services, including RSS feeds, to retrieve data from Event Plus or provide data to us.

15.4.By “information” we mean facts and other information about you, including actions you take.

15.5.By “content” we mean anything you post on Event Plus that would not be included in the definition of “information”.

15.6.By “data” we mean content and information that third parties can retrieve from Event Plus or provide to Event Plus through Platform.

15.7.By “post” we mean the events, comment and action of “like”, “dislike” and “unlike” you posted on Event Plus or otherwise make available to us.

15.8.By “use” we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.

15.9.By “active registered user” we mean a user who has logged into Event Plus at least once in the previous 30 days.

Others

16.1.This Statement makes up the entire agreement between the parties regarding Event Plus, and supersedes any prior agreements.

16.2.If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.

16.3.If we fail to enforce any of this Statement, it will not be considered a waiver.

16.4.Any amendment to or waiver of this Statement must be made in writing by us.

16.5.You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.

16.6.All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

16.7.Nothing in this Statement shall prevent us from complying with the law.

16.8.This Statement does not confer any third party beneficiary rights.

Information you provide to us

  • Personal information. When you sign up for Event Plus you provide us with your name, email, and some other information like your gender and Date of Birth. In some cases we may ask for additional information for security reasons or to provide specific services to you.
  • Content. One of the primary reasons people use Event Plus is to share content with others. Example includes entering the information of an event in Event Plus.
  • Transactional Information. We may retain the details of transactions or payments you make on Event Plus (for advertisers only).
  • Location Information. When you share your location with others or add a location to something you post, we treat that like any other content you post.

Information we collect when you interact with Event Plus

  • Site activity information. We keep track of the actions you take on Event Plus, such as viewing an event and making comments on an event. In some cases you are also taking an action when you provide information or content to us. For example, if you post an event, in addition to storing the actual content you uploaded, we might log the action you have taken.
  • Access Device and Browser Information. When you access Event Plus from a computer, mobile phone, or other device, we may collect information from that device about your browser type, location, and IP address.
  • Cookie Information. We use “cookies” (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) to make Event Plus easier to use, to make your search more desired, to make our advertising better, and to protect both you and Event Plus. For example, we use them to store your login ID (but never your password) to make it easier for you to login whenever you come back to Event Plus. We also use them to confirm that you are logged into Event Plus and our advertisements. You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use Event Plus.

Information from other websites.

We may institute programs with advertising partners and other websites in which they share information with us:

  • We may ask advertisers to tell us how our users responded to the ads we showed them (and for comparison purposes, how other users who didn’t see the ads acted on their site). This data sharing, commonly known as “conversion tracking,” helps us measure our advertising effectiveness and improve the quality of the advertisements you see.
  • We may receive information about whether or not you’ve seen or interacted with certain ads on other sites in order to measure the effectiveness of those ads.

We take steps to ensure that others use information that you share on Event Plus in a proper manner, but we cannot guarantee that they will follow our rules. Read the following section to learn more about how you can protect yourself when you share information with third parties.

Sharing information on Event Plus.

Here are some specific things to remember:
  • You understand that information might be re-shared or copied by other users.
  • Certain types of communications that you send to other users cannot be removed, such as comment on post.
  • If you use an external source to publish information to Event Plus (such as a mobile application or a Connect site), you should check the privacy setting for that post, as it is set by that external source.
  • Information you shared (except the personal information you provided to us during registration) is publicly available information, may be accessed by everyone on the Internet (including people not logged into Event Plus), is subject to indexing by third party search engines, may be associated with you outside of Event Plus (such as when you visit other sites on the internet), and may be imported and exported by us.
  • You should always review the policies of third party to make sure you are comfortable with the ways in which they use information you share with them. We do not guarantee that they will follow our rules. If you find anyone that violates our rules, you should report the violation to us and we will take action as necessary.

Exporting Information

You (and those you make your information available to) may use tools like mobile phone address books, or copy and paste functions, to capture and export information from Event Plus, including your information and information about you.

Advertisements

Sometimes the advertisers who present ads on Event Plus use technological methods to measure the effectiveness of their ads and to personalize advertising content. You may opt-out of the placement of cookies by many of these advertisers. You may also use your browser cookie settings to limit or prevent the placement of cookies by advertising networks.

Links

When you click on links on Event Plus you may leave our site. We are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements. For YouTube videos in the YouTube “Embeddable Player” on Event Plus, although you do not leave our site, it follows all the terms of YouTube. Event Plus bears no obligation and responsibility of your action of viewing the video.

We use the information we collect to try to provide a safe, efficient, and customized experience. Here are some of the details on how we do that:

To manage the service

We use the information we collect to provide our services and features to you, to measure and improve those services and features, and to provide you with customer support. We use the information to prevent potentially illegal activities. For example, we ask for your date of birth to verify that you are over age 18 and so that we can better limit your access to content and advertisements that are not age appropriate. Maintenance may on occasion result in a temporary or permanent suspension or termination of some functions for some users.

To contact you

We may contact you with service-related announcements from time to time.

To serve personalized advertising to you

We don’t share your information with advertisers without your consent. We allow advertisers to choose the characteristics of users who will see their advertisements and we may use any of the non-personally identifiable attributes we have collected (including information you may have supposed not to show to other users, such as your birth year or other sensitive personal information or preferences) to select the appropriate audience for those advertisements. For example, we might use your interest in music to show you ads for concerts, but we do not tell the advertisers who you are. Even though we do not share your information with advertisers without your consent, when you click on or otherwise interact with an advertisement there is a possibility that the advertiser may place a cookie in your browser and note that it meets the criteria they selected.

Event Plus is about sharing information with others. We share your information with third parties (other users and advertisers etc.) when we believe the sharing is permitted by you, reasonably necessary to offer our services, or when legally required to do so. For example:

When you choose to share your information with marketers

You may choose to share information with marketers or electronic commerce providers that are not associated with Event Plus through on-site offers. This is entirely at your discretion and we will not provide your information to these marketers without your consent.

To give search engines access to publicly available information

We generally do not limit search engines’ access to our site. We may allow them to access information you shared in Event Plus.

To help improve or promote our service

Sometimes we share aggregated information with third parties to help improve or promote our service. But we only do so in such a way that no individual user can be identified or linked to any specific action or information.

To provide you with services

We may provide information to service providers that help us bring you the services we offer. For example, we may use third parties to help host our website, process payments, or provide search results or links (including sponsored links). These service providers may have access to your personal information for use.

To advertise our services

We may ask advertisers outside of Event Plus to display ads promoting our services. We may ask them to deliver those ads based on the presence of a cookie, but in doing so will not share any other information with the advertiser.

To respond to legal requests and prevent harm

We may disclose information pursuant to subpoenas, court orders, or other requests (including criminal and civil matters) if we have a good faith belief that the response is required by law. This may include respecting requests from jurisdictions outside of Hong Kong where we have a good faith belief that the response is required by law under the local laws in that jurisdiction, apply to users from that jurisdiction, and are consistent with generally accepted international standards. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you. This may include sharing information with other companies, lawyers, courts or other government entities.

Transfer in the Event of Sale or Change of Control

If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the service can continue to operate. In such a case, your information would remain subject to the promises made in any pre-existing Privacy Policy.

We do our best to keep your information secure, but we need your help.

Steps we take to keep your information secure

We keep your account information on a secured server. We may also use automated and social measures to enhance security, such as analyzing account behavior for fraudulent or otherwise anomalous behavior, may limit use of site features in response to possible signs of abuse, may remove inappropriate content or links to illegal content, and may suspend or disable suspect accounts.

Risks inherent in sharing information

Please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We cannot ensure that information you share on Event Plus will not become publicly available. We are not responsible for third party circumvention of any security measures on Event Plus. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different services, and using up to date antivirus software.

Report Violations.

You should report any security violations to us.

Changes

We may change this Privacy Policy on Event Plus. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account. If we make changes to this Privacy Policy we will notify you by publication on Event Plus.

Consent to Collection and Processing in Hong Kong

By using Event Plus, you consent to having your personal data transferred to and processed in Hong Kong.

Defined Terms

“Us,” “we,” “our,” and ” Event Plus ” mean the same as they do in the Statement of Rights and Responsibilities. “Information” and “content” are used more generally and interchangeably here than in the Statement of Rights and Responsibilities unless otherwise limited by the context.

What is a cookie?

Cookie is a small file that contains letters and numbers that is downloaded on to your device when you visit a website. It is sent to your browser and stored on your computer’s hard drive, tablet or mobile device. When you visit our sites it can allow us to recognise and remember you.
Technologies similar to cookies. Technologies that store or access information on a user’s device are similar to cookies and are also covered by this policy. These technologies may include:
  • Device fingerprinting – using a set of information without relying on cookies in order to identify a particular device. For this purpose where you are resident in Australia, our partner Ipsos Iris may collect your IP address, monitor settings, type of browser and operating system to create a unique serial number which constitutes a digital “fingerprint”.
  • Local storage – storage of data in the local device’s cache, for example to load content quicker.
  • Pixels – a small pixel graphic which is used to track user behaviour, site conversions etc.
  • Scripts – small computer programs embedded within websites that give them extra functionality but may access user devices.

In this policy we call all cookies and similar technologies “cookies”, for ease.

First-party and third-party cookies

There are different types of cookies:

  • First-party cookies – cookies that are set by or on behalf of the Event Plus when you use our site.
  • Third-party cookies – cookies that are set by parties or organisations other than the Event Plus when you use our site. Some Event Plus web pages may also contain content from or link to other sites which may set their own cookies. If you share a link to a Event Plus page, the service you share it on may set a cookie on your browser.

How do we use cookies?

We use cookies in a range of ways to improve your experience on our sites, including:

  • Keeping you signed in.
  • Delivering content to you.
  • Showing you journalism that is relevant to you.
  • Delivering marketing and service messages to you on our site.
  • Understanding how you use our site, for instance, how long you stay on a page or which article you read next.
  • Showing you Event Plus products and services that are relevant to you.
  • Working with partners to deliver relevant advertising to you.
  • Reminding you to complete online registration.
  • Processing payments and refunds.
  • Monitoring how users interact with pages on our site to identify and remedy technical issues.

What types of cookies do we use?

We use four types of cookies:

  • Strictly Necessary – These cookies are essential to provide you with services you have requested, which means they cannot be switched off through the “Privacy settings” link. For example, strictly necessary cookies make it possible for you to stay logged into your Event Plus account and make comments. If you set your browser to block these cookies, then these functions and services will not work for you. In particular, we won’t be able to save your preferences about cookies.
  • Performance – These cookies measure how often you visit our sites and how you use them. We use this information to get a better sense of how you engage with our journalism and to improve our sites so that you have a better experience. For example, we collect information about which of our pages are most frequently visited, and by which types of users.
  • Functionality – These cookies are used to recognise you and remember your preferences or settings when you return to our site so that we can provide you with a more personalised experience. For example, if you are based in the HK, we will remember this and make sure that you receive the HK homepage when you visit our site, rather than the US or Australia homepage.
  • Advertising – These cookies are used to collect information about your visit to our site, including the content you have viewed, the links you have followed and information about your browser, device and your IP address. We have set out more details on our use of advertising cookies below.

How long do cookies last?

  • Session cookies – These cookies only last as long as your online session and expire when you close your browser (e.g. Chrome or Safari).
  • Persistent cookies – These cookies stay on your device after your browser has been closed and last for a time specified in the cookie (but not longer than 13 months). We use these cookies when we need to remember you for more than one browsing session, for instance to remember your preferences from one visit to the next.

How do we use cookies for advertising?

If you accept cookies, as you browse our site, we will place cookies on your device. Some cookies are for advertising, so we can understand what sorts of pages you read and are interested in viewing. We can then display advertising on your browser based on these interests. For instance, if you have been reading a lot of food articles, you may be shown more adverts for food.

Our apps integrate third-party software that provides us with information about how the app is used and what content you have viewed for the purposes of online advertising and analytics. It uses cookies from some of the providers listed in our “Privacy settings”, that can be found in the footer of every page on our site. We sometimes use information such as your IP address and browser type, and also sometimes share these with others for advertising purposes.

We also allow other organisations to use cookies and other technologies to help us analyse how our site is being used, measure the number of visitors to the site, and display advertising.

How do third parties use cookies for advertising?

With your consent we share and receive online data collected through cookies with our advertising partners. This means that when you are on another website, you may be shown advertising based on your browsing patterns on our site. We may also show you advertising on our site based on your browsing patterns on other sites that we have obtained from our advertising partners.

Online retargeting is another form of online advertising that allows us and some of our advertising partners to show you advertising based on your browsing patterns and interactions with other sites. The use of cookies may mean that when you are on another site, you may be shown advertising based on what you have looked at on our site. For example, if you have visited the website of an online clothes shop, you may start seeing adverts from that same shopping site displaying special offers or showing you the products you were browsing. This allows companies to advertise to you if you leave their website without making a purchase.

We require that all our contractual partners treat your personal data with a similar level of respect that we would provide.

How can you control advertising cookies?

If you reside anywhere in the world (except Hong Kong or China), you can exercise control over advertising cookies by clicking the “Privacy settings” link in the footer of every page on our site. For more information, please read “How to manage cookies at the Event Plus” below.
